Kota Kinabalu City Hall has clarified that house owners who are renting out their units on a daily basis is violating its Building By-Laws and Local Government Ordinance, as reported in New Sabah Times.
City Hall's Head of City Planning Department Stanley Chong said Section 3© Building By- Laws 1951 prohibits any person to convert or adapt any building to a purpose other than that for which it was originally approved.
Hence, a building that has been approved in a residential zone such as condominium, apartments, terrace houses are not allowed to conduct any commercial activity.
Those house owners are advised to cease their operation and failure to do so will risk legal taken against them under the Building By-Laws and Local Government Ordinance.
Under the Building By-Laws, they can be compounded not exceeding RM500 and fined RM500 plus RM50 per day for repeated offences.
While under Section 103A Local Government Ordinance (Amendment) 2000, City Hall can close or demolish premise that violates its by-laws and Ordinance. Therefore, those who are operating illegally are advised to stop their operation immediately.
